Credit Bureau (Cambodia) Co., Ltd. (“CBC”) is the leading provider of financial information, analytical solutions, credit reporting services to financial institution and consumers in the Kingdom of Cambodia. CBC App aims to provide you with the highest quality application available.
We may alter the features by adding and/or removing in the future at our sole discretion, whereby, whether or not, those will be thereof governed by additional terms and/or this T&C.
Please carefully and thoroughly vet through these T&C.
By ticking and/or clicking “I Agreed”, you agreed with the terms and conditions set forth below and gave consent to the CBC for using and utilizing your data in line with the T&C set forth hereunder:
1. General Conditions
- Consent: Upon agreeing and concurring with these terms and conditions, You hereby and hereof are giving your consent to the CBC in regard to submission, collation and provision of your own and personal data supplied therein the App for usage and utilization at the sole discretion of the CBC, as well as your consent to the CBC to generate your own credit report in compliance with the Prakas on Credit Reporting on purpose to deliver to you upon your request.
- Amendments: From time to time, we may amend these terms and conditions, inclusive of credit report fees, additional terms thereof, whatsoever, at our sole discretion without compulsory prior notice to you. These updates and/or changes will be eventually uploaded to our website at www.creditbureau.com.kh, and/or will without compulsory obligation be notified to you through the in-app notification.
- Terms and Conditions: These terms and conditions, inclusive of but not limited to additional terms, conditions, clauses, whatsoever, that are bound together with these terms and conditions constitute as the final and applicable Terms and Conditions for CBC Mobile Application—herein referred to as "T&C".
- Disclaimer: This App provides no financial consultancy or advice, apart from the provision of consolidated financial information and other information collectively collated from various sources and this information do not represent the opinion of Credit Bureau Cambodia. No liability (in contract or otherwise whatsoever) attaches to the CBC with respect to the collation or supplying of the information or any use made of it and whether in relation to its accuracy or completeness or any other matter whatsoever. The information is supplied on a confidential basis to you and not for the use of any other party.
- Dispute Resolutions: Any complaint(s) arisen from the use of this App and/or related to your credit report delivered to the App shall be made either: (1) CBC Office; or (2) CBC’s email. CBC reserves all legal rights to directly contact you as if required to resolve the complaint filed; otherwise, the complaint is rejected.
- Applicable law and jurisdiction: The application process and these T&C shall be governed by and construed in accordance with the law of the Kingdom of Cambodia. Any dispute arising from these shall be subject to the exclusive jurisdiction of Cambodian Courts.
- Language: The application process and the T&C are available in both Khmer and English (upon the language of the App selected). In the event of any discrepancy or conflicts of meaning between the two languages, the Khmer language shall prevail.
- Throughout these T&C, the words “You”, “Your” and “Yours” shall refer to the User in respect of the App accessible by using mobile phone or other electronic devices.
- Throughout these T&C, “We”, “Us”, “Our” and “Ours” shall refer to the CBC.
1.1 Objective
This App is created for the objective as below:
- To allow consumers to request their own personal credit report via CBC Mobile Application;
- To promote financial literacy on credit reporting system in Cambodia via CBC Mobile Application; and - Others legitimate usage.
1.2 Definitions
In these T&C, the following definitions apply unless otherwise stated:
- CBC Mobile Application (or the "App") shall refer to this mobile application, whereby this T&C defines all the terms and conditions in regard to the usage and modalities.
- Profile (or "User Profile") shall refer to user account registered and activated in and through the App.
- User shall refer to you being as the legal person, having the age at least 18 or above, who is the owner of the device installing the CBC Mobile Application, in whose name the Profile has been registered in, activated through the CBC Mobile Application, and is entirely responsible for the Profile under this T&C.
- Business Day shall refer to the day when businesses and companies are open for business operations and transactions and whereby those days exclude public holidays, Saturday and Sunday.
- Payment shall refer to a function to make a payment for the service(s) requested within App.
- Financial Institution shall refer to bank, microfinance institution, leasing company or other financial organizations as licensed and/or recognized by the National Bank of Cambodia.
- Device shall refer to any electronic device, including but not limited to, mobile phone or tablet.
- IMEI – "International Mobile Equipment Identity" – shall refer to a 15- or 17-digit code that uniquely identifies the mobile phone set.
- Legal Person –shall refer to an individual or company that has full legal rights and responsibilities according to the law with the age of 18 and above.
- PIN (Personal Identification Number) – or "PIN Code" – shall refer to a four-digit confidential code you use to access and/or to authorize all the process(es) throughout the App, inclusive of but not limited to authorizing the request, making payment, and so forth.
2. Modalities of Mobile Application
2.1 Registration Requirement
You hereto agreed to provide us with the following required information, including but not limited to, on purpose to use the App.
- Name
- Khmer Identity Card or Passport
- Date of Birth
- Gender
- Residential Address
- Mobile Number
- Personal E-mail
- A selfie photo of you holding the Identity
- A photo of Your Identity.
2.2 Fee, Payment & Delivery Methods
Credit Reporting Fees (or the "Fees") are offered with different bundled pricings (hereinafter the "Bundle") to best suit your needs in regard to request for the credit report. The details of the Fees will be available in, inclusive of but not limited to, the display in the App itself, or via the CBC website.
Delivery Method
Delivery Channel will be exclusively conveyed via the Personal E-mail provided above.
Delivery Date will be determined by you in regard to the Bundle chosen, whereby the Bundle comprises of Normal Package, Regular Package, Enhanced Package and Ultimate Package comprising of one, two, three and four credit report(s) respectively.
- For Normal Package, the credit report will be delivered within the next three business days.
- For Regular, Enhanced and Ultimate Packages, the first credit report will be delivered within the next three business days, whereby the following credit report(s) will be delivered upon the date set forth by you.
Payment Method will be made through debit/credit card and/or banking account of financial institutions, which institution the CBC has cooperated with for payment and settlement.
2.3 Promotional and/or Referral Program
You agreed with and hereby have been aware that we will have been providing you via the App with promotional content(s), inclusive of but not limited to ads of products or services, feature to invite friend(s) to receipt/redeem points ("Referral Code"), coupon code, whatsoever.
CBC is entitled to review and take action to delete any content deem inappropriate.
2.4 Device Identity, Permission and Conformity
2.4.1. Identity of Device
CBC, at its sole discretion, from time to time reserves all legal and legitimate rights, for verification purposes, to capture your device\s identities, including but not limited to IMEI, etc.
2.4.2. Permission of Device
Certain and particular sensitive accesses, inclusive of but not limited to IP location and address, access to camera, will be exclusively permitted by you by prompting for your consent before the App can use and/or access to those functions therein the App.
2.4.3. Conformity of Device
You are entirely responsible for Your own device in regard to device\s operating system to ensure that the security settings are not bypassed, whereby this refers to, including but not limited to, jailbreak (Apple Inc\s operating system "iOS") or root (open-source operating system "Android"). You hereby and hereof as set forth herein the T&C agree that the CBC Mobile Application is not allowed to use and/or You are not to use the CBC Mobile
Application when the Device having the App installed has been bypassed its security settings
in form of jailbreak for iOS device(s) or root for Android device(s), or the words of like import, whatsoever.
2.5 Validity, Locked and Unlocked
2.5.1 Validity
The Profile remains, once registered and activated, active and valid until it is deactivated or deleted at the sole discretion of the CBC in accordance with the T&C set forth herein.
2.5.2 Profile Locked and Unlocked
The Profile, under the T&C, at the sole discretion of the CBC, will be locked as per one or more of the following circumstances: - 3 (Three) consecutive failed attempts of Password.
- Request for Profile Lock made by you.
- Any breach of the T&C.
- At sole discretion of the CBC, followed by a notification delivered to you, either via, including but not limited to, e-mail, phone number or in-app notification.
In order to unlock Your Profile after it has been locked, You are required to contact the CBC Office via phone number at +855-23-999006 or physically visit us at address: Vattanac Capital (Level 9), #66 Preah Monivong Blvd., Wat Phnom, Daun Penh, Phnom Penh.
2.5.3 Account Deactivate
CBC is entitled to deactivate the account in the case as below:
- The account or the user is inactive up to or over 01 (One) year(s);
- Request for termination from the user;
- Breach any term or condition of this T&C; and
- At CBC’s sole discretion.
3. User Responsibility
3.1. User Consent
You, upon agreeing and registering this App, as stated herein the T&C, voluntarily and willingly gives unconditional and irrevocable consent to the CBC for the purposes, including but not limited to, to generate credit report for you, using the data provided by you, and other purposes permitted by-laws.
3.2. Prohibited Usages & Privacy
- The usage of the App is for the sole purpose as stated in the point above. - You must be 18 years or above.
- You must not send e-mails or messages, post blogs, publish or download content through the App in any way, which intended to deceive, infringe copyright or other intellectual property rights, breaches confidential information, privacy or any other rights, is done with any criminal or terrorist intent.
- You must not use the App for any attempt(s) to hack or gain unauthorized access to any computer, account, equipment, network or information on passwords or data belonging to another party.
- You must not transmit, post, upload, or otherwise making available defamatory, harassing, abusive, or threatening material that encourages bodily harm, destruction or property or harasses another.
- You must not attempt to forge or modify the header(s) or content(s) of the App, including but not limited to, likewise in-app notification, notification alert(s), in-app message, description, whatsoever, whether in whole or in part, or to mark the originator of the App\s message.
- You must not use the App to conduct or to have the App involved in any activities that involve the distribution of virus(es) or other destructive activities.
- There may be embedded applications, plug-ins, widgets, as well as links to third-party sites that may offer you goods, services, or information. Some of these sites may appear within our site. When you click on one of these applications, plug-ins, widgets, or links, you will leave our site and will no longer be subject to CBC’s privacy policy and privacy practices. We are not responsible for the information collection practices of the other sites that you visit, and we urge you to review their privacy policies before you provide them with any personally identifiable information. Third-party sites may collect and use information about you in ways that are different from our practices.
- You must not bypass the device\s security settings, in which this refers to the jailbreak for iOS device(s) or root for Android device(s) when and/or after installing the App. As consequences, the CBC at its sole discretion might deactivate your Profile, once this is detected by the App itself, and you are thereafter required to follow the procedures stated herein the on purposes to reactivate Your Profile.
- You are entirely and wholly responsible for Your own device having the App installed, in regard to the data stored there in the device, whereby the device might have been lost, stolen, jail-broken or rooted, whatsoever, which circumstances lead to data leakage or exfiltration or loss.
3.3. Cookies and other associated software from our partnered service provider(s)
When you use the App, we and our services providers (including advertising providers) may place cookies or other similar technologies on your computer or device. A cookie is a piece of data stored on your hard drive. It takes up very little room on your system and helps us to tailor our websites and applications. You can set your web browser to inform you when cookies are placed on your computer or mobile device, or you can prevent them from being placed. However, if you choose to prevent cookies from being placed, some of our website or application functions may not work properly. Unless you register with us for the App, the cookies do not link to any personally identifying information about you. You can find more information about cookies here. In addition, we and our service providers (including advertising providers) may collect information using cookies or other similar technologies about your browsing activities over time and across other websites after vising our websites and applications.
3.4. Efforts on Safeguard the Information Collected
CBC and each of its affiliates agree not to disclose to third parties any financial information you have provided or that CBC and/or its affiliates have obtained through usage of the App thereunder unless it is:
- To comply with laws and regulations or appropriate government agency or court orders’ request.
- To verify the existence and condition of your usage;
- Upon any circumstance deem necessary.
3.5. Release and Limitation of Liability & Warranties - You are liable for any losses arising from the acts and omissions of all users of the App. This includes you and any person authorized by you to carry out command in the App.
- You shall be liable for any losses or damages including losses suffered by yourself, if you negligently act or attempt to make command, invasion, searching, data cheating, fraudulence directly or indirectly, either alone or with any persons. You will face the law even though you act intentionally or inadvertently.
- You agree to comply with all applicable laws, rules and regulations such as Law on Anti-money Laundering and Combating the Financing of Terrorism of the Cambodia, and you are responsible for compliance with the local laws. We do not make representation that any content.
- You agree to take every precaution to ensure the safety, security and integrity of your transactions when using this App.
- You are required to comply with all of these terms and conditions of the T&C and in particular, the conditions of using the App properly and securely avoid any unauthorized transactions. You may only use App with your own mobile phone or device that was registered by yourself.
- We will not be liable for damage, loss, deletion of data due to fault or malfunction of your mobile phone, electronic device or force majeure such as war, fire, earth quake, storm, flood, etc., that is beyond control of both parties.).
- We will not be liable for any defect or deficiency your mobile or electronic device’s software.
3.6. Indemnification
To the extent permitted by the applicable law, You agree to indemnify CBC against any loss or damage which CBC may suffer due to any claim, demand or action of any kind brought against CBC arising directly or indirectly because:
- Failure to observe Your obligations under the T&C; or
- Acted negligently or fraudulently in connection with the T&C.
4. Intellectual Property
Document, software, hardware and everything in the App is property of CBC so you must not misuse it. CBC retains all its intellectual property rights in any software and documentation relating to the App, including any subsequent amendments, modifications or introductions.
Any trademarks including logos, trading names, service names, color schemes, slogans and taglines displayed in respect of the App are owned by or licensed to the CBC. Nothing contained in App shall be construed as granting any license or right to use any such trademarks without the prior written consent of the CBC.
The User acknowledges and agrees: a) that the CBC is granting you a non-exclusive, non-transferable, temporary license to use App and this permission is restricted to authorized legitimate use of the service; b) not to use property of the CBC except in connection with accessing and using App; c) not to make copies, sell, assign, commercially rent, sub-license or otherwise transfer property of the CBC to any third person; and d) not to attempt to decompose, reverse or tamper with the system or software related to the App.
